Section 3 of Ordinance 15 of 1901
prevented the grant by the Crown of leases of foreshore
etc. so as to derogate from the rights of a Crown
section lessee without his consent. The proviso to elenge 5
had a similar effect in connection with the grant
of rights of erecting and maintaining piers etc. where
there was no lease. Section 2 of the amending
Ordinance substitutes for the Crown lessee's power of
obstruction in the former case a right to compensation,
but the effect of section 3 is apparently to take away
that power in the latter case without giving any such
right. I suggest that we should enquire whether this
is intended, and if so, why?
