be advised to exercise his
power of disallowance in respect
of Ordinance No.43 of 1933, of
the Legislature of Hong Kong
entitled "An Ordinance to amend
the Protection of Women and
Girls Ordinance, 1897".
2. I am advised that from
the point of view of legal
principles the amendment effected
by Section 3 of the Ordinance,
involving the omission of the
words

words "in any public place" from
sub-section 1 of Section 17 of the principal
Ordinance, is open to criticism.
Criminal
law does not as a rule purport to deal
this type of moral offence
with questions of merels, except in so

far as they affects or are likely to
affect the public peace or to amount to
a public nuisance or scandal, and
under most criminal codes soliciting is
not an offence unless it takes place in
public.
