Enclosure No. 2.

6

ATTORNEY GENERAL'S CHAMBERS,

Hong Kong 26th February, 1932.

REPORT ON ORDINANCE No

4

of 1932.

1. I have examined the accompanying Ordinance. intituled an

Ordinance to amend the Po Leung Kuk Incorporation

Ordinance, 1893, and I am of opinion that the Ordinance

is one which is not contrary to the Governor's instructions.

2.

Under section 5 (1) of the principal Ordinance the

Permanent Board of Direction of the Po Leung Kuk was made

to consist of not less than five and not more than ten

persons including the Secretary for Chinese Affairs, as

ex officio president, and also the members of the

Legislative Council representing the Chinese, as ex officio

vice-presidents.

3. Until recently the representative of the Chinese on

the Executive Council was also a member of the Legislative

Council. The primary object of this amending Ordinance is

to enable him to retain his ex officio position as a vice- president.

4. As, however, there will now be a president and four

vice-presidents it is thought that a maximum of five

ordinary members may be insufficient.

Ordinance accordingly removes the limit to their number

imposed by the principal Ordinance.

7 END

5. The opportunity has been taken to add 5 sub-sections

to section 2 of the principal Ordinance giving the Society

powers to make and deal with investments similar to the

powers given to the Tung Wah Hospital by sections 5 and 6

of Ordinance No. 31 of 1930.

6. In my opinion this is an Ordinance to which His

Excellency the Governor may properly assent in the name of

His Majesty and on His behalf.

ababest

Attorney General.
