NOEL INSTONE BREWER.
The Governor in Council further considered
the petition from Mrs. Instone Brewer: Council by a majority of 7 to 2 advised that no pardon should be granted to Mr. Instone Brewer and that consequently no compensation should be paid.
His Excellency accepted the advice of the majority. The Honourable the Attorney General
and the Honourable Mr. W.E.L. Shenton required that
the following statements of the grounds for the advice given by them should be recorded in the Minutes :-
The Honourable the Attorney General adhered to the
opinion expressed in his minute of the 26th February,
1931, that the Benchers' decision should be accepted
and that a free pardon should be granted with
compensation.
'The Honourable Mr. W.E.L. Shenton dissented from
the views of the majority of the members because he
stated that having closely perused the Police Court
de positions and the shorthand transcript of the
session trial before the Acting Chief Justice and a
Common Jury he was of the opinion that Mr. N.I. Brewer had been wrongly convicted on the indictment on which he was arraigned, that the facts showed no offence in law on the charge in question, that the jury were misled and that the trial was not conducted according to the usually recognised procedure.

He was, therefore, of the opinion that Mr. N.I.
Brewer was entitled to a free pardon and compensation.
