One, Nguyen ai quoc, an Annamite, was arrested in Hong Kong, and a deportation order was made under section 3(1)c of the 1917 Ordinance, (as subsequently amended in 1931). The Governor also,
on instructions, utilised section 6 of the Ordinance
to order expulsion by a ship leaving for Saigon, where the French are extremely anxious to catch him. Nguyen ai quoc himself states that his arrival at
Indo China will be followed by his immediate execution, and this notwithstanding, there are no grounds for extradition proceedings against him. The Attorney-General, Hong Kong, was against sending this man to French territory on the ground that it was for all intents and purposes extradition in a case where no extradition proceedings lay. This course was, however, adopted in deference to the
wishes of the French authorities. On 11th and
12th September last the Full Court in Hong Kong,
to which Nguyen ai quoc had appealed, declared the orders under sections 3 and 6 to be valid, but gave leave to appeal to the Privy Council, Nguyen ai quoc being detained in police custody in the meantime, and his counsel stated that the appeal was because of the shipping order under section 6, and if that
were withdrawn and Nguyen ai quoc allowed to leave
Hong Kong in his own way, he would do so. This is how things are at present, except an application has been received to permit this man to come to England, which has not yet been dealt with.
