With reference to your letter of the 23rd July
(82826/31), regarding the judgment of the Full Court of
Hong Kong in the case of Rex v. Chung Tam Kwong and others,
I am directed by the Board of Trade to state that they
concur in Lord Passfield's view that it would be desirable
to obtain a judgment by the Privy Council with a view either
to quashing the judgment of the Hong Kong Court or to
introducing amending legislation.
I am to add that the Board do not consider that they
should bear any part of the cost of the appeal.
A copy of this letter has been sent to the Admiralty.
