thought that upon the assumption
that the powers conferred upon the
Court by Section 1 of 12 and 13
Victoria Chapter 96 are municipal,
except in so far as the offence
charged is jure gentium, and con-
sequently justiciable anywhere,

the suggestion appears to involves
the proposition that a conspiracy to
act piratically is jure gentium.
It has not been possible to trace
any authority for or against such
a proposition, either in the
reports or textbooks. The suggestion
made in the Admiralty letter can only
be tested before the Courts of Hong
Kong, but in view of the present
judgment, Mr. Thomas is advised
that it is meet unlikely that they
