I rang up Mr. Reeve Wallace, at the
Privy Council Office, and put the facts of the
case to him. He mentioned that under the Indian
Code the Crown had a right of appeal against an
acquittal, and said that in the present case there
was nothing to prevent our lodging a petition for
special leave to appeal, and our asking the Board,
in the circumstances, to dispense with the necessity
of serving notice of such petition on the
respondents. He thought, however, that it was
very doubtful indeed if the Board would allow an
appeal against an acquittal, and that the best
course would be to consult the Law Officers of the
Crown before taking any action. He also mention the Isusual difficult, regarding appeals to the P.C. in criminal cases. I think we had now better wait for
the
the replies from the Admiralty and Board of Trade.
