With reference to Mr. J. H. Thomas' confidential
despatch of the 10th of September, 1931, regarding the draft Articles of Agreement between the Hong Kong Government and Imperial and International Communications
Limited, I have the honour to offer the following
observations upon the points raised in that and in Lord 34 Passfield's confidential despatch of the 25th of August,
1931:-

Article 1.
I agree that this Article should be amended in
order to allow the Company to carry on radio telephonic communication with ships at sea subject to the conditions set out in the Colonial Office letter to the Company of the 10th of August, 1931.
3.
Article 2 (c).
I consider that the item '(c) broadcasting
services' should be retained in this Article but that the term should be more clearly limited or defined by the
addition of some such words as "for which no direct payment
is made".
