(3) No person shall be deemed to have committed a breach of the provisions of this section if during the term of such banishment he has been within the Colony on one occasion only for such period as may be reasonably neces- sary for him to make arrangements for his departure : Provided however that it shall be lawful for any police officer to arrest and detain any such person or to take such other steps as may be necessary to facilitate or to expedite his departure.

Ordinances

12.-(1) Every person who is prohibited from being Penalty for within the Colony either by virtue of a deportation order return from made under this Ordinance or made under the Deportation deportation Ordinance, 1917, or by virtue of the provisions of section 11 of this Ordinance, or of the provisions of section 11 of the Deportation Ordinance, 17 or of section 8 of the Nos. 9 of Deportation Ordinance, 1917, and who without lawful 1912, and authority or excuse is within the Colony after the date 25 of 1917. fixed by such deportation order for his departure and before the expiration of the period of his deportation, or at any time contrary to the provisions of any of the said sections, shall be guilty of a misdemeanor.

(2) When any such person is convicted summarily before a magistrate, he shall be liable to imprisonment for any term not exceeding one year.

(3) When any such person is .convicted on indictment, he shall be liable to imprisonment for any term exceeding five years in cases where the period of deporta- tion or banishment exceeded fifteen years, to imprisonment for any term not exceeding three years in cases where the period of deportation or banishment did not exceed fifteen years but exceeded five years, and to imprisonment for any term not exceeding two years in cases where the period of deportation or banishment did not exceed five years.

(4) Where the period of deportation or banishment is for life, such period shall be deemed to exceed fifteen years for the purposes of this section.

13. Every person who without lawful authority or Penalty for excuse knowingly harbours or conceals any person who harbouring. is prohibited from being within the Colony by or under this Ordinance shall upon summary conviction be liable to

a fine not exceeding two hundred and fifty dollars.

Detention.

14. The Governor may appoint any building or portion House of of a building to be a House of Detention for the purposes of this Ordinance and any person to be Superintendent of such House, and in default of such appointments Victoria Gaol shall be the House of Detention and the Superintendent of Prisons shall be the Superintendent of the House of Detention.

15.—(1) In any proceedings whatsoever, a deportation Evidence, order signed by the Clerk of Councils, or a copy of a deportation order certified by the Clerk of Councils, shall be deemed conclusive evidence that the deportation order was duly and validly made and issued against the person named in such order and that the order was made on the date therein specified.

(2) In any proceedings whatsoever, any document which purports to be a deportation order and to be signed by the Clerk of Councils, or any document which purports to be a copy of a deportation order and to be certified by the Clerk of Councils, shall, until the contrary is proved, be deemed respectively to be a deportation order signed by the Clerk of Councils or to be a copy of a deportation order certified by the Clerk of Councils.

(3) In any proceedings whatsoever, an order of banish- ment purporting to be signed by, or a copy of an order of banishment purporting to be certified by, any of the
