I think that the Ordinance goes

too far in one direction, and that the Chief

Justice's Bill goes too far in the other.

The compromise which we intended, and which

still think is reasonable, is

(1) that there should be an enquiry

before a Judge;

(2) that the Judge should have complete

control of the enquiry, both as to its

conduct and to the procedure;

(3) that the Judge should be entitled to

hear such evidence, whether hearsay or not, on

either side as he thinks proper, and give it

such weight as he considers it deserves;

and

(4) that the Judge should not recommend

whether the person ought to be deported, which

should be a matter for the Governor: he should

report whether the allegations are, in his view,

proved.
