When I have advised and a despatch purpotting

agree that we should thank the 0.A.G. for the expla-
nation. He has not informed us as to why the additional
penalty in section 9(2) is considered necessary in
this particular case; and as regards section 6(1),
the mere fact that it is usual to substitute the Gov-
ernor for the High Court where an English Act allows

an appeal to the High Court does not alter what I said in my minute of 30/3/31, namely, that it would
be more appropriate if the appeal were to the High
Court as in the Imperial Act of 1919.

As the points in question were not taken when
the draft Bill was submitted, and as the Ordinance and Regulations have been submitted to the Nursing Authorities in England and Wales, Scotland, Northern Ireland, and the Irish Free State (see the end of paragraph 2 of the A.G's report of 7/2/31 enclosed in No.1), in all the circumstances perhaps we had better not take any further action in the matter.
