on the other part,
hereby declare to have agreed as follows :
I. 1. The Labourer shall do the following work in behalf of the mining
concessions mentioned above of the N. V. 00ST-BORNEO MAATSCHAPPY, viz:
all such work in connection with mining, which can be reasonably
demanded from Chinese labourers, as also the carriage or transport of
coal to the loading stations of the Oost-Borneo Maatschappy used for
sending the coal further on and the loading of the coaling vessels, as
also the discharging of all materials and food stuffs arriving for the
Oost-Borneo Maatschappy at the loading or discharging stations and
their further transportation therefrom to the respective warehouses of
the various mines.

What kind of work will be assigned to any of the labourers will be
at all times left to the discretion of the Superintendent.
3. The labourer shall, at the discretion of the Superintendent, either
work for daily wages, or execute a daily task, or be engaged on piece-
work, or work according to a contract, and shall execute all work assigned to him in the manner as will be fixed by the Superintendent.
II.1. The number of hours during which the labourer shall have to work in
the mines, mentioned under I-1., will be:

a.
for labour on the surface, on every working day, at most 10 hours
per diem, if the work is being executed between 5.30 a.m. and 6 p.m. and at most 8 hours per diem, if the work, wholly or partly, is
performed between 6 p.m. and 5.30 a.m. -
b. if the work, wholly or partly, (i.e. during at least 4 hours) is executed under ground, the maximum working hours shall be 8 per diem.
In these working hours is included the time during which the labourer has been engaged on extra work, such as transport, watches, etc. as also the time used for the roll-call and the division of labour and
the time necessarily employed by the labourer to cover the distance from his home to the place where he has been ordered to work and back
