It may be that the case is not
specifically dealt with in the Letters Patent,
but there can be no doubt that the intention
of the various clauses on this subject is that
the prerogative of all such matters is to be
delegated to the Governor.
I do not think we need go into the precise construction of the Letters Patent, because I doubt whether any real point of law
arises.
It is obvious that the effective
order with regard to the prisoner must be, and can only be made by the Governor. The question
therefore resolves itself into a consideration
of constitutional propriety, and I think the answer is that it is for the Governor, upon his
own responsibility, to make known His Majesty's pleasure, and that it is not necessary for him
to refer the matter for precise instructions.
