part of the settlement should be carefully worded so
as to include everything.
13. I propose to deal with the question of
legal liability very shortly, and, I should say, on
only a cursory consideration of it. If proceedings
are ever commenced it will be necessary to go into the matter much more fully. For the purpose of
considering the question of legal liability it is necessary first to inquire what promises or representations, if any, were made with regard to a proposed Government reclamation eastward of Marine
Lot 431.
The matter seems to be referred to in
only three letters by the Director of Public Works:-
(a) 23.6.23: "The lines of roads......
will be continued so far as is consistent
with the future development scheme for the
area east of Marine Lot 431 and west of
430".
"The Government proposed to
reclaim an area of sea bed abutting on the
eastern limit of the reclamation to be
carried out by Matine Lot 431, further, it
is proposed to protect the area so reclaimed
by Government, with a quay wall to be
continuous and of similar type as approved
for Marine Lot 430 and 431".
(b) 17.10.23: "The Government undertakes that
the vertical sea wall will be extended
continuously eastward in connection with
future reclamations".
