CONDITIONS OF EMPLOYMENT.

1. Term of Engagement.
The engagement is for a term of THREE YEARS dating from the day the transport leaves China, after which the labourer will be repatriated to China. The labourer may be repatriated before expiry of his term of service on approval of the Administrator.
2. Free Passage.
The Administration of Western Samoa will provide a free passage for each labourer to Samoa, and will also pay the cost of his passage when he returns home to China.
3. Advances of Wages.
At the time of embarkation each labourer will receive an advance of wages of $15.00 (Fifteen dollars) Hongkong currency, and this sum will be deducted from the half pay referred to in Para 4.
4. Half Pay.
The labourer will receive half pay from the date of sailing from Hongkong till the date of landing in Samoa.
5. Abolition of Punishment for Labour Offences.
No labourer arriving in Western Samoa shall be punished by fine or imprisonment for any breach of service.
6. Continuous Employment.
The Commissioner will offer continuous employment to the labourer as an agricultural labourer or domestic servant or otherwise at a guaranteed wage of three (3/-) shillings per day with time and a half for overtime work provided the labourer will give his services faithfully and continuously for the term of the engagement as set out in paragraph one (1).
Free quarters are provided for all labourers in employment.
7. Employment on Arrival.
On arrival in Samoa the Commissioner of Labour will appoint each labourer to an employer, and will have regard as far as is practicable to the wishes of the labourer; and if the labourer after being appointed to an employer wishes to change his employer, the Commissioner will when practicable and if a valid reason in the opinion of the Commissioner is given, permit the labourer to do so.
8. Benevolent Fund.
Each labourer will subscribe the sum of six pence (6d) per week to the Chinese Benevolent Fund to be used for the charges of Free Medical Attention for labourers in hospital or otherwise, free maintenance of chronically sick labourers, the upkeep of the Chinese Cemetery and other benevolent purposes.
9. Care of Labourers.
The Commissioner of Labour will take all reasonable care that the labourer is not ill-treated and he will investigate any complaint made by the labourer and see that justice is done.
