departure from the general principle should only be approved on two conditions:-

(a) That the foreign countries to which the proposed provision will apply should be limited

to China and the neighbouring territory: and

(b) That it should be provided that the

act committed in China or the neighbouring

territory must be a crime according to the law

of the place in which it was committed as well
