the basis of the limitation disappears, and the

state concerned cannot complain if the warships

of foreign states do not allow their attempte

world in those waters from being frustrated by

the pirates being enabled to use the waters

asylum. Should the etate concerned make

protest in such circumstances, it would expose

itself to the reproach of making its sovereign

rig te into a protection for acts of piracy, com-

måtted not only in its own waters but also on the

high seas.

13. But apart from this general considera-

tion, which is in itself decisivo, there can

obviously be no objection to a warship taking

action against pirates in the territorial

waters of another state if that state has

invited her to do so, and the facts show

that such is the ouse here. So far as the

relevant treaty provisions are concerned there
