but the following considerations will demonetrate

that this fact gives the Butional Government of

China no grounds for protest.

12. His Majesty's Government are content

to assume for the purposes of this discuss on

that as a general rule the right to take action

#gainst pirates does not extend to the terri-

torial waters of another state, though they are

interested to note a passage (p.118) in the

Report of kl. katsuda and Wang Chung-Hui, to

which wr. Wu attached so much importance, which

Boems to indicate that they held the contrary

Tiew. But such a limitation of the right to

suppress piracy, if it existe, is based on the

assumption that modern states are in a position

to exercise, and do exercise, a measure of

control over their territory and territorial

waters sufficient to ensure that they do not

become the scene of, or still more

base for,

piratical operations.
