11. The second contention, that the
action of the L.4 took place in Chinese

territorial waters, is but faintly put forward
both in Mr. Eu's Note and in Your Excelleney's,
and I am not altogether clear whether what is
complained of is the fact of the I.d having
taken action against pirates in Chinese ter-
ritorial waters, or of the upreme Court
of Hong Kong having exercised jurisdiction
over the captured pirates.
I do not thik
however, that any uncertainty which may
exist on this point is material, einse if the
L.4 was entitled to capture the pirates it
follows that the Courte of the flag state had
Jurisdiction to try them. Without entering
into the question whether the whole of Bias Bay
is to be regarded as territorial, His Lajesty's
Government do not dispute that the action of
