I have had a file of papers sent to me from the Colonial
Office this morning with instructions to obtain Counsel's opinion
and to confer with you as to the Counsel to be retained with
a recommendation that he should be a Chancery man.
If you want a Chancery junior I would suggest Mr. Swords
and if you want to give him a leader then I should recommend Mr.
Gavin Simonds.
Personally from a hasty perusal of the papers I am
inclined to agree with the opinion of Eldon Potter K.C. but it
occurs to me, however, that before going to Counsel at all we
ought to see a copy of the Memorandum and Articles of Association
of the Tai Koo Company as unless they have power to sell water
the Government's best remedy would appear to be an injunction to
restrain them. I will have a search made at Somerset House
tomorrow to see if the Company is registered here, and if so,
will look up the provisions of their Memorandum and Articles.
