shipment, and the remaining three machines complete and
three extra engines two weeks after the second shipment.
It is understood that shipment is subject to the
usual FORCE MAJEURE clause, which includes fire, strikes,
lockouts, act of God or Government, typhoon, loss of vessel
or vessels on which the aeroplanes may be carried, cargo
being shut-out or refused by the shipping company and, in
fact, any circumstance over which the seller has no con-
trol.
Subject to these agreed conditions the Seller agrees
to deliver in Hongkong the first four machines and four
extra engines on or before sixty days from the signing of
this contract and/or the payment into the bank of the first
deposit the time to begin from whichever event last takes
place. Should the cargo arrive at Hongkong later than the
time stipulated, and the delay is proved to be the fault
of the Seller, the Seller agrees to refund to the Pur-
chasor at the rate of one per cent for each days delay
The agreed price of one machine complete as stated with
one extra Cirrus Mark III is Hongkong Dollars TEN THOUSAND TWO HUNDRED AND FIFTY ONLY ($10,250.000) including packing
freight and marine insurance to hongkong.
The Seller is to instruct the Shipper to insure ship-
ments for ten per cent above cost.
In payment for this order the Purchasor agrees to pay
into the account of the Seller with the Hongkong Shanghai
Banking Corporation at Canton a first payment of Hongkong Dollars FORTY THOUSAND immediately ($40,000.00) the
balance owing of Hongkong Dollars SIXTY TWO THOUSAND FIVE HUNDRED ($62,500.00) to be paid to the Seller against
delivery of the order ex ship Hongkong 1.e. The sum of
Hongkong Dollars SIX THOUSAND TWO HUNDRED AND FIFTY
($6,250.00) will be paid to the Seller against shipping documents covering each complete machine and extra engine
upon
