of State on behalf of His Majesty the King has been
Gazetted.
4. In this connection however, certain doubts
have arisen as to the correct form of appointment to
Membership of Legislative Council and I have the
honour to request instructions on the points raised.
The points are as follows:-
(a) Should the instrument of provisional and
temporary appointment be followed by an instrument
of definitive appointment upon the receipt of His
Majesty's confirmation of the provisional appointment,
and instructions for the definitive appointment of
the person provisionally appointed?
(b) Should the instrument of definitive
appointment in the case of an unofficial member
expressly state that the appointment is for four years,
observing the initial dates laid down in clause III
of the Additional Instructions of the 10th January
1922 ?
(c) Should the instrument of provisional
appointment in the case of a (nominated) official
member, whose appointment is practically based on his
acting in a particular office, be expressed to be
conditional upon his continuing to act in that office ?
(a) Should the instrument of definitive
appointment in the case of a (nominated) official
member whose appointment is practically based on his
tenure of a particular office, be expressed to be for
so long as he shall continue to hold that office ?
