With reference to your letter, 52727/28 of the

21st December, in regard to the proposed amendment of the

Hong Kong Shipping Ordnance of 1899, I am directed by the

Board of Trade to state, for the information of

Mr. Secretary Amery, that they have no observations to

make on the draft Bill except as regards the point to

which attention was called in the letter addressed by

your Department to the Foreign Office on the 21st December

last.

The Bill as drafted fails to deal with the case of

a ship clearing from Hong Kong for some place outside

the inland waters of China and then proceeding to those

waters and trading therein, and I am to suggest that, if

the Secretary of State sees no objection, the officer

Administering the Government of Hong Kong should be

asked to consider whether it is not necessary, if the

position is to be adequately met, for a penalty to be

/imposed
