The opportunity has also been taken
to amend Clause XIV of the Royal instructions of 1917 so as to permit of a provisional appointment to the Legislative Council being made by the Governor whenever it is desired to appoint a
person temporarily in the place of an unofficial
Member who is acting in a post the holder of
which is an ex-officio Member of the Council. The Instructions hitherto in force only provided
for this to be done where an official Member
Was so acting. In this connection I would
invite reference to my despatches Confidential (2) of the 30th of May, 1925, and Confidential of the 24th July last, and to your Confidential despatch of the 5th of September. In view of this
amendment there will be no further necessity to adopt the procedure indicated in those despatches.
3. A paragraph has been added to Clause XIII
to provide that in the event of an official
Member of the Legislative Council ceasing to hold public office in the Colony his seat in the Council is thereby vacated. hitherto the
position has been somewhat obscure when an
Official Member retires or is transferred to
another Colony without resigning nie seat.
