i am directed by the Board of Trade to refer to your

letter of the 22rd November (äeference 10. F 6000/5175,107, and

to previous correspondence, on the subject of the position under

the Companies note of a company registered in england which

tranesate business in Shanghai and desires to open a branch

register in that Jity

I am now to transmit to you, for the information of

hecretary Dir susten Chamberlain, a copy of a letter which has

to-day been sent to Lesare. 'tephenton marwood &

tephenson Herwood & athem on the

subject.

The Board desire me to state that in their view it

would not be possicle under Section 50 of the mong none

Companies Ordinance of 1911 for the Shanghal aegistrar to give

a licence to a company regiɛtered in this country to keep a

local register in China, having regard to the definition of

"company" contained in Section 261 of that urdinance which

is referred to in paragraph 3 of your letter and which reads

as folloW8 : -

'Jompany”msɛne a cosplay formed und registered under this urdinance or sa existing company.

"xisting company" meant

MOANE 2 company formed and registered under the

Companies ordinance, 1865, or under the Companies Registration ordinance,

1866".

hovember and its enclosurer has been sent to the Treasury and

to the Colonial office in order that the question whether, as
