Gentlemen,

I am directed by the Board of Trade to refer to

your letter of the 26th November, and previous sorrespondence,

regarding the questions raised in the letter addressed by you

on the 2nd October last to the Privy Council office on the

subject of the position under the Companies Acts of a comp) any

registered in England which transacts business in Shanghai and

desires to open a branch register in that city.

In reply I am to inform you (taking the questions

in your letter of the 2nd October in order) as follows: •

(1) The Board are advised that Sections 34 to 36 of

the Companies (Consolidation) Act, 1908, could be extended

to China by Order-in-Council under the Foreign Jurisdiction

Acts.

(2) This question has already been answered by the

Privy Council in their reply to you dated 3rd October'.

(3) and (4). These questions will not arise.

On the question whether, as a matter of policy, it is

desirable to extend the Restions in question to China, the

Foard are in consultation with the Foreign Offion and the

Colonial office.
