1.

I have examined the accompanying Ordinance intituled an Ordinance to amend the Magistrates Ordinance, 1890, and I am of opinion

that the Ordinance is one which is not contrary to the Gover-

-nor's instructions.

2.

This Ordinance makes a number of minor amendments in

the Magistrates Ordinance, 1890, Ordinance No.3 of 1890.

That Ordinance has also been amended by Ordinance No.2 of 1926

Section 2 amends section 8 of the principal Ordinance

by making the Decuty Harbour Master a marine magistrate.

When that section was amended in 1926 the office had not been

created.

4. The proviso to section 10 (2) of the principal Ordinance, 1890, provided that nothing therein contained, i.e., presu-

-mably, nothing contained in section 10, should oblige a

magistrate to issue a summons in any case where the defendant

appeared voluntarily or upon his recognizance or was in the
