This paper has been delayed because
correspondence was still proceeding on the
Straits Settlements file, which has only just
become available.
As the correspondence relating to this
draft clause is very bulky, I annex within copies
of the actual despatches sent to the Straits and
Hong Kong. The draft clause is tabbed
"X" and is dealt with in sub paragraph (h)
(tabbed "Y") of Straits Settlements despatch
of the 11th August and in the numbered ("Z")
and confidential ("W") Straits despatches of
the 27th October. The confidential despatch
("W") explains why Sir Malcolm Delevingne's
views were not adopted.
It may also be desirable to summarise
here the process by which the draft clause was
evolved. In the following paragraphs references
all relate to Gov. C.F. 5439/26 Straits

of the Straits Ordinance (tabbed "A") was
included in a draft despatch (which ultimately
became No.13 on the file) which was sent to Mr.
Perrins with my letter of the 6th July, 1926
(No.6 on the file -tabbed "B").
You will
recollect that we prepared this draft clause in
consultation. The letter to Mr. Perrins gives
additional reasons to those mentioned in the
draft despatch why an amendment of the section
was considered necessary.
