An Ordinance to amend the Chinese Extradi-
tion Ordinance, 1889.
Be it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows:-
1. This Ordinance may be cited as the Chinese Extra- Short title. dition Amendment Ordinance, 1927.
2. Section 2 of the Chinese Extradition Ordinance, Amendment. 1889, is amended as follows:-

(a) by the repeal of the definition of "Chinese S. 2.
Government" and by the substitution therefor of the following definition :—
The Govt.
(a)" Chinese authorities means any person recognised by the Governor for the purposes of this Ordinance as representing the government of the Republic of China, or as representing the actually exercising authority in any province or other territory which, in the opinion of thể Governor, forms or at any time has formed part of the Republic of China.
(b) by the addition of the following definitions imme- diately after the definition of “Fugitive Crimi- nal" :-

(d) Jurisdiction of China” includes the juris- diction of any government recognised by the Governor for the purposes of this Ordinance as actually exercising authority in any province or other territory which forms or at any time has formed part of the Republic of China.
(e) “Subject of China" includes every person born within the dominious of the Emperor of China, or horn in any province or other territory which forms or at any time has formed part of the Republic of China.
3. Paragraph (3) of section 4 of the Chinese Extradi- Amendment tion Ordinance. 1889, is amended by the repeal of the of Ordinance
No. 7 of 1889, word "Government " in the second line thereof and by 8. 4. the substitution therefor of the word "authorities ".
4. Section 6 of the Chinese Extradition Ordinance, Amendment 1889, is amended by the repeal of the words "some officer of Ordinance of the Chinese Government in the third and fourth lines. No. 7 of 1889, thereof and by the substitution therefor of the words "the Chinese authorities ".

Objects and Reasons.
1. The object of this bill is to remove certain doubts that have arisen in the construction of the Chinese Extra- dition Ordinance, 1889.
