I have the honour to refer to Your Excellency's
despatch to the Colonial Office No.328 of the 14th July, of
which you have been kind enough to send me a copy. The
despatch deals with the legal difficulties involved in
extraditing fugitive Chinese offenders from Hong Kong to
China, and as the subject is of great importance to British
relations with the Canton Government, I venture to offer the
following observations in the hope that they may be found
useful.

In the first place, I would draw Your
Excellency's attention to the bill for amending the Chinese
Extradition Ordinance, 1889, enclosed with your despatch
under acknowledgment. It states that section 2 of the
ordinance is amended by the repeal of the definition of
"Chinese Government" and by the substitution therefor of
another definition. I have, however, been unable to find
any definition of the term "Chinese Government" either in
section 2 or any other part of the ordinance. If there is
an amending Ordinance dealing with the point, I shall be grateful for a copy as it is not contained in any of the
