I have the honour to state that I have had under consideration the conditions governing the grant of pensions on abolition of office. The rule previously in force in Hong Kong operated unevenly and in particular cases harshly, and the Executive Council unanimously advised the substitution of a rule based on the rule in force in Ceylon. Copies of the old and new rules are enclosed.

I regret that by inadvertence the amended rule was published in the Gazette before your sanction had been obtained, and I shall be glad if I may have your covering authority for the amendment.

In this connection I would also ask sanction for an amendment to paragraph 3 of Clause 11 of the Pansion Minute. The paragraph provides that if a cadet fails to pass his final examination in Chinese within the prescribed period, which under General Order 25 paragraph 2 is two years, the period by which his date of passing is overdue "will be deducted" from his term of service in calculating his pension. No exception is here made to provide for cases of delay in passing the final examination due to

circumstances not within the control of the officer, as

for example, illness, recall to Hong Kong on duty, or
