Knight, of 4/5 charles street, St. James " Square, London, England, send greeting HERBAS the lands situate in the golong of Hongkong and atre partenerly delineated and desaribed on the maps a plane hereto annexed and referred to in the schedulej here to with the buildinge thereon and the appurtenances thereto Bro now vested in the Army Council (which designation where used in these presente includes the gecretary of state for st and the war offies) in fes simple in possession or for an estate or interest deered for the purposes of there presents tɔ be the equivalent Alt) WEREAS the Qɔvernment of the colony of Hongkong being desirous of Vaking transfer of or purchasing from the Army gɔunell the said lands entered into negotiatione with the Army gouncil therefor AND ZIERBAR in and for the said negotiations I the said sir John Hubert Oakley was appointed by the Army Council to přɔssed to the said colony and to aɛcertain the value of the said lands AfD WHEREAS after my arrival at the said golony to take up the dinës of the said appointment the Army Council and the Germaent of Honging through their respective representatives agreed that subject only to the provisoss or reservations hereinafter set forth within ten yean from the date of this my award (time in thie respect being of the essence of the agreement) the Arvy council would sell and transfer to the Governant of Hongkong and the vernsent of Hongkong would purchase from the Army (ɔuncil at the total price or sma to be awarded by me all the said lands which lands for the purpose of such sale should be treated as an indivisibile whole save only that in case of withdrawal of one or mora ecuplete block x lot or blocks or lote as hereinafter sentioned then the remaining blocks or lots or block or lot not, so withdraw should in like manner be treated as an indivisibl whole as to which the male and transfer should be empleted and take effect in secordance with my award AND HI ZAS the proviɛɔes or reservations hereinbefore referred to are as fullows, that is to say - (1) That if during the period of ten years from the date of the award and before empletion of the transfer unforgeen eircumstances shall in the opinion of the Army (Junell render it desirable or expedient to withdraw any one or more complete bliek or lot or blocks x lots then and in such event only the Army Connell shall be free and at liberty to withdraw such one or more eɔmplete block a lot or blʊeke or lete and (ii) That if the gun total of the award shall be demed by the government of Hong cơng to be a greater price than the maid colony can afford to pay and the governor of Hongkong shall in writing infom the general Hfficer Commanding the Færses in China thereof at the earliest possible date being not later than four months from the date of the award then the Governsent of Hongkong shall not be bound tɔ prieved with and emplete the purchase and transfer or tɔ progeen with the reprovisioning of the garrison elsewhere AIP CHRJAR the blocks * lots hereinbefore referred to are the rõveral plaçes of land. shown on the said sape or plans and thereon indicated by distinctive golɔuring and mumbering and also described in the said schedule as separate itën# #0% (N94 Yg that I the gaid sir John Hubert akley having takần upon myself the duties obligationsg and burthen of the said appointment and reference and having been attended by the representatives in Hongkong of the Army Council and the Governsent of Hongkong and their witnesses and by witnessee called by myself and having heard and considered the allegations and proofs so before me and having viewed all the said lande and having alɛs in making this ay award regarded not only the value of the interest of th● Army Council in the landa described in the gaid schedule but also any damage to be sustained by the Army gouncil in the -event of sale and transfar as aforesaid by reason of the
