Under instructions from His Majesty's
Foreign Office I have to bring to your notice that by
Article 124 of the Order in Council of 1904 the master of
any and every British ship is bound when required to take any person or persons ordered by His Majesty's Supreme Court or any of His Majesty's Provincial Courts in China
to be deported to any place in China, Hongkong, England or
elsewhere for a reasonable remuneration to be determined
by Judge of His Majesty's Supreme Court under penalty for non-compliance not exceeding £50,
While no exception can be made of any
British vessel from the above duty and the terms of every deportation order must be strictly complied with by the
master of such vessel, and while no master can insist on a
deportatus, neither violent nor a lunatic, being accompan-
ied by an escort, there is no desire to lay the duty unduly on any particular line and, other things being equal, leading mail steamere will be avoided,
As long notice as possible will be given to the agents of any steamer on which it is intended to send a daportatus in order that the master may be made aware of his right to attend before a Judge for reasonable remuner- ation, (the amount of which is entirely within the discret- ion of the Judge,) beyond the ordinary passage-money.
