I have the honour to acknowledge the receipt of Your Grace's Confidential despatch of the 1st of December, 1922, with regard to the constitution of the British Court
of Appeal for China and to state that this Government will be pleased to meet the wishes of the Secretary of State for Foreign Affairs.

I enclose a copy of a minute by the Chief Justice with whom I have discussed the question. As circumstances may make it impossible for the Chief Justice to be absent from the Colony at the time when a third Judge is needed in Shanghai we suggest that the Order in Council should be so framed as to make it possible for the Puisne Judge or another Judge, if in the future an additional judge should be appointed in this Colony, to take his place.
The proposals as to the relative precedence

of the members of the Court are quite satisfactory.
As regards remuneration, we desire to ask that there shall be complete reciprocity i.e. the remuneration given to the Hongkong Judge shall be the same es that given to the Shanghai Judge from Colonis) Revenues and the travel] ing expenses shall be at the same rate.
The remuneration to the Shanghai Judge from Hongkong funds is £300 a year, which for the sake of
convenience
