I have the honour to inform you that questions have arisen with regard to the
interpretation of paragraph 10 of the Annex to Article 296 of the Treaty of Versailles, which
deals with the collection of fines by Clearing Offices in certain cases.
2. This paragraph does not contemplate either the infliction of a fine by a British
Clearing Office on a British national claiming through it in the cases specified unless and
until a demand to that effect is made by the German Clearing Office, or the demand of a fine
where the British claim has been made bona fide. An agreement has been arrived at
between the British and German Clearing Offices, whereby a fine will in no case be claimed
unless and until 14 days' notice of the intention to demand a fine has first been given by the
opposing Clearing Office. In this connection I would invite reference to paragraphs 8
et seqq. of the letter from the Controller of the Clearing Office of the 2nd September, 1920,
a copy of which was enclosed in Viscount Milner's Confidential Circular despatch of the
3rd December, 1920.
8. The interest mentioned in the paragraph in question is at the rate of 5 per cent.
per annum and not merely 5 per cent. of the amount involved.
4. I shall be glad if the Controller of the local Clearing Office can be informed
accordingly.
5. I take this opportunity to state that the Controller of the Clearing Office has asked that the special attention of Controllers of local Clearing Offices should be drawn to the second paragraph of the memorandum referred to in paragraph 7 of my Circular despatch of the 14th September, 1921, which deals with the procedure in cases where proceeds of liquidation have been credited under Article 297 (h) (†) of the Treaty of Versailles and it is desired to
withdraw the credit.
