received in respect of the earnings of the said steamship the
gross sum of $835,465.89 and have paid to the plaintiffs the
gross sum of $238, 793.55 and have retained as profit the sum
of $59 6, 672.34.

The Plaintiffs have never assented to the Goverment
retaining the said profit.

The said profit is not required in aid of or in connec-
tion with the defence of the Colony and its retention by the
Goverment is not warranted by any Act of Parliament,
Ordinance,
Order in Council, Royal Prerogative or other lawful authority.
The Plaintiffs therefore claim:-

The said profit as money received for the use of the
Plaintiffs.
(b)
In the alternative the said profit as compensation
(c)
(a)
for the requisition user and control of the said
steamship.
Such declaration as to the Plaintiffs rights and
Buch further and other relief es the nature of the
case may require.
