The Plaintiffs have never assented to the Government retaining the said profit.

The said profit is not required in aid or or in connect- ion with the defence of the Colony and its retention by the Government is not warranted by any Act of Parliament, ordinance,

Order in Council, Royal Prerogative or other lawful authority.

The Plaintiffs therefore claim :-

(a)

The said profit as money received for the use of

the Plaintiffs.

(b)

In the alternative the said profit as compensation

for the requisition user and control of the said

Steamship.

(0)

Such declaration as to the Plaintiffs rights and

such further and other relief as the nature of

the case may require.

(a)

Costs.
