As I ran I saw the short European and the Chinese running. I did not see anybody running in the same direction. I saw him run into the arms of a man at the top of Wardley Street. I continued until I reached where the man was. That is the man who stopped the Chinese who was running away (Pereira). The man was in the act of getting up from the ground. The prisoner is the man. I seized him by my left arm. Captain Morgan reached the top of Wardley Street. about 15 feet ahead of me. I saw no other Chinese running at the top of Wardley Street. The only 2 I saw running were the man and the short European who was. chasing him. I did not notice anybody
el se running in that direction.
Cross-examined.
If "aptain Morgan says when he ran up Wardley Street that I was standing by the railing he is wrong. The man I saw ran between the gardens the Bank garden and the Supreme Court garden. My impression was he came between the 2 pillars shown on plan. It was the European who drew my attention to him. He was in the road. Captain Morgan was about the distance from witness box to
* the pillar. Captain Morgan was losing ground in the street. Then
I first saw them the Chinese had just emerged into Des Voeux Road Whils Captain Morgan was in the road between the 2 gardens. I did not hear police whistles or see any Chinese on the run, On the road between the 2 gardens I am not sure whether he was on the road or on the pavement. My difficulty In my previous answer was I did not know which road you referred to. I did not see any Chinese fireman. I would not awear as whether anybody went up the steps going to the theatre. When I got out of my ricksha the China- man about as far as am to the pillars towards the end of the Court. Captain Morgan was in front. I was overhauling him, I was about 15 feet behind. I went back to the Praya. I then left the scene. I did not see the revolver or the ricksha. I actually saw the man arrested. I can't swear that some Chinese did not go from the road between the gardens some to the right and some to the left. Re examined.
I was looking across towards Wardley Street when I firet sav the 2 men. I did not then see any Chinese running in Des Voeux Road.
