correct nor that anybody ran along the pavement. I did not see

Chinese come up Wardley Street to Des Voeux Road some to the right

and some to the left. There were not men running and turning up

the seps leading to the theatre. I did not see the shot fired.

I am 63. My eye sight is good. I was wearing a felt hat, I don't

know if the man was carrying a revolver, I can't say how it got

into the garden. If you say that 2 men running in front of the man

and one of the two threw the Evolver into the garden I did not

see it. If they got there before me they might. If the 2 men were

a minute before me they might have done so. It may have been a.

minute. there may have been 2 men there.

Re-examined,

I am quite sure I saw nobody except the prisoner.

To the Court.

When I saw this man in custody of the 2 men at the top of the' street. I had no doubt he was the man I saw running up the street.

I expressed no doubt to anybody. The 2 Europeans were about 50 or

60 yards up Wardley Street when I saw them seize the man. I chased the man across Statue Square. I lost sight of him as he turned from Des Voeux Road to Wardley Street but I am sure the man I saw running in Wardley Street before he was caught was the same man as I chased along Statue Square,

To the Jury.

The man who fired was about 8 feet behind the rickana.
