of them. I entirely failed to discover any ground for

this proposition. The revolver night equally well

have been thrown in from Wardley Street. The Chief

Justice made the same remark in his summing up. No

one to whom I have spoken has been able to see anything

in the point.

5. Another point, treated as a main point by the de-

fence, was that Larkins's marking of the plan disproved

Korgan's evidence that he (Morgan) had the prisoner in

Bight practically all the time from the Praya to Dea

Voeux Road.

Larkins saw three "pictures", the Euro-

pean and the firemen, the ricksha, and the Chinese run-

ning on the foothpath near the Bank garden. He marked

on the plan the position of these three "pictures". It

was suggested to him in cross-examination that taking

in these three pictures was only a matter of a moment

and he assented.

In commenting on this and on Lar-

marking of the plan, Mr. Jenkins assumed that

the three "pictures" were simultaneous, and that the

European must still have been at the position marked
