Im directed by the Controller to refer to your
letter 54475/21 of the 17th November, transmitting a
copy of Hong Kong despatch No. 350 of the 10th September,
asking for instructions on certain points arising in
connexion with paragraph 10 of the Annex to Part X, Section
III of the Treaty of Versailles, and to express regret for
the delay in replying thereto.
2. The various points raised in fir R.E. Sturk's
despatch can probably best be answered by stating that the
paragraph in question does not contemplate a British
Clearing Office inflicting a fine on a British national
claiming through it until, and unless, a demand to that
effect is made by the opposing Clearing Office, or that
there should be any question of demanding a fine in the
case of a claim made bona fide. Tith regard to point (a)
the interest' is at the rate of 5 of the amount in
question and not 5 per annum.
3. An agreement has been arrived at between this
Department and the German Clearing Office whereby a fine
will in no case be claimed unless, and until, 14 days
notice of the intention to do so has first been given by
the opposing Clearing office.
I am to enclose a copy of the Controller's letter of
the 2nd September 1920 to the German Clearing office
Representative accredited to this Department, in paragraph 3
