Copy of Supplementary Agreement.

THIS agreement, made the 2nd day of August, 1920 (No. 2 day of the 8th moon of the 9th year), between the Government of the province of Kwangtung, in the Republic of China, represented by their Excellencies the Military and Civil Governors of the province of Kwangtung (hereinafter called the "Kwangtung Government "), of the one purt, and the Anglo-Chinese Proprietary Syndicate (Limited) (hereinafter called "the company"), of the other part, whereas these presents are supplemental to an agreement (hereinafter called "the agreement") dated the 23rd day of April, 1920, and made between the Kwangtung Government, of the one part, and Major Louis Cassel and Sum Pak Ming, as trustees for and on behalf of a syndicate (hereinafter and therein- after called the syndicate"), of the other part, and whereas the syndicate have assigned unto the company the agreement and full and exclusive benefit thereof, and whereof up to the date of these presents the official sanction and approval of the Central Government of China at Peking has not been obtained to the agreement, and whereas the parties hereto are desirous that the Kwangtung Government shall ratify the agreement subject to the provisions herein contained; now it is hereby agreed between the parties hereto as follows:-

1. The company will, upon the execution hereof, deposit with the Kwangtung Government the sum of 100,000 dollars, Hong Kong currency, referred to in clause 2 of the agreement (the receipt whereof the Kwangtung Government doth hereby acknowledge).

2. The agreement be and is hereby varied by substituting the words 15 months for the words "9 months" wherever auch words appear in clauses 3, 4 and 13 of the agreement; and also by substituting the worde "21 months for the words

15 months" in clause 13 of the agreement.

3. That subject to the provisions hereof, the Kwangtung Government doth hereby ratify and confirm the agreement as from the date of these presents.

Legation of the United States of America, My dear Colleague,

Peking, November 15, 1920. THIS Legation has been informed that in April of this year the Military and Civil Governors of Kwangtung signed an agreement granting to a proposed English syndicate the absolute and sole right of mining coal throughout Kwangtung for ninety years with a privilege of renewal, and also the right to construct the necessary railroads. 1 should be grateful, dear Mr. Chargé d'Affaires, if you would inform me as to the correctness of this information, and whether, in your knowledge, any such agreement on these or like terms has been entered into.

Peking, November 18, 1920. WITH reference to your despatch No. 63 of the 12th July last and to subsequent telegraphic correspondence on the subject of the Cassel mining agreement, I have to inform you that Major Cassel, accompanied by Mr. Sun Pak-ning, visited Peking at the end of September, and repeated conferences were held with them to discuss the best method of procedure in seeking to obtain ratification of the agreement by the Central Government,

The sudden change in the political fortunes of the Military and Civil Governors who had signed the agreement, and which eventually resulted in their disappearance from the scene, naturally complicated matters and prevented compliance with the necessary formality of notification by the provincial authorities to the Central Government of the agreement, in spite of your efforts to secure such notification before General Mok's departure.
