Art. 2.-Persons may not possess, or have in their possession, morphine or cocaine without
proper reasons.
Art. 3.-Druggists or manufacturers of drugs who wish to manufacture morphine or cocaine must obtain the sanction of the Commander-in-chief of the army. Application for such sanction must be made through the local civil administration, and particulars of the description and quantity of the drug must be supplied.
Art. 4. No persons other than druggists or manufacturers of drugs may import morphine or cocaine.
Art. 5.-Persons who wish to import morphine or cocaine shall, after furnishing the particulars specified below, first obtain the sanction of the local civil administration.
(1.) Description and quantity.
(2.) Proposed use.
(3.) Name of manufacturer.
Port of export and name of consignor.
(5.) Method of shipment and port of import.
Art. 6.-Morphine and cocaine may only be sold to such persons as are recognised to use the drugs for professional purposes, and who furnish a statement in writing and sealed with their seal giving particulars of the description, quantity, proposed use, date, name, address and profession.
This does not, however, apply in the case of a medical practitioner, dentist or veterinary surgeon using morphine or cocaine in the preparation of medicine for a patient, or in the case of a druggist preparing medicine containing morphine or cocaine for a person producing a prescription of a medical practitioner, dentist or veterinary
surgeon.
The written statement of purchase or the prescription shall be preserved on file for a period of ten years.
Art. 7.-Persons concerned in the manufacture, purchase, sale, import or export of morphine or cocaine shall keep special books in which they shall enter in a clear manner details of receipt and disposal.
Such books, as well as goods in stock, may be inspected by the local authorities concerned whenever it is deemed necessary.
Art. 8. The civil administrator may issue to dealers any instructions deemed necessary for the control of the trade in morphine and cocaine, and may also determine the form of books required for recording receipts and disposals of morphine and cocaine. Art. 9.-Persons infringing the provisions of articles 2 to 7 (section 1), or persons refusing to submit their books to inspection in accordance with article 7 (section 2) or persons infringing the provisions of article 8 shall be liable to a maximum fine of 1,000 yen.
Art. 10.-Morphine or cocaine possessed or found in the possession of any persons in contravention of the provisions of articles 2 to 6 shall be confiscated in addition to any administrative measures that may be taken.
Supplementary regulations.
These regulations shall go into force as from the day of issue.
Persons who possess, or have in their possession at the moment the present regula- tions are issued, any morphine or cocaine with the object of selling, delivering or exporting these articles, shall, within ten days from the date of issue of the present regulations, report the description and quantity.
