Sir:-
With reference to your despatch No. 149 (6020/20)
of the 14th ultimo on the subject of the effect on the
British-American Tobacco Company of the proposed amendment
of the Hongkong Companies Ordinance of 1915, I have the
honour to enclose herewith a Minute by the Acting Crown
Advocate, with which I am in entire agreement, expressing
the opinion that the position of the Company will not be
affected by an amending Ordinance on the lines of Article 3
of the 1919 Order in Council, as the general or substantial
control of the business of that Company will be exercised by
persons resident in Hongkong, and not by "persons ordinarily
resident within the limits of this Order".
