(8) Partnership Instrument. It will be noticed that the

definition is not limited to instruments used in the for-

mation of a partnership.

(h) Person. This was inserted for the purposes of the sixth

column of the schedule. It was inserted in committee,

and by an oversight no marginal note was added.

(i) Servants security agreement.

This definition is taken

from article 46 of the schedule to Ordinance No. 16 of

1901.

(j) Share.

This definition was adapted from 54 and 55 Vict.

c.39, .122, but the term share was used instead of the

word stock. The marginal note should have read "share"

Sub-sections (E) and (6) of section 5 make the payment of

stamp duty a civil debt, and the non-payment of stamp duty a criminal

offence, except where in the schedule stamping is stated to be

voluntury.

Section 6 makes all unstamped instruments inadmissible in evi-

dence or for registration, even though, at the time when the instru-

ment is tendered, the payment of duty has not yet, by lapse of time,

become a civil debt or a criminal liability.
