4. The power of making by-laws has been given in this case to the Governor in Council because the management of Holte Wharf is not in the hands of a legal entity, but in that of a firm, Mesara Butter- field and Swire.

5. The proposed by-laws have been modelled closely on the by-lawa made and approved under the Hongkong and Kowloon Wharf and Godown Company's Ordinance, 1908.

As the bill was treated as a Government measure it was coneid- ered that the provisions of Article XXVII of the Royal Instructions, relating to publication of private bills, and to the Governor's cer- tificate, did not apply in this case. The advertisements, however, required by Rule 55 of the Standing Rules and orders of the Legisla- tive Council were inserted, except that it was considered unnecessary

ahy to advertise the bill in/Chinese newspaper. The usual saving

clause appears in the Ordinance.

7. In my opinion this is an Ordinance to which His Excellency the Governor may properly assent in the name of His Majesty and on His behalf.
