An Ordinance to make certain provisions relating to Aliens, Former Enemy Aliens and Passports and to amend the Deportation Ordinance, 1917.

Be it enacted by the Governor of Hongkong, with the advice and consent of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as the Aliens and Short title. Passports Ordinance, 1921.

2. (1) Where an alien acquired a nationality at Nationality birth he shall be deemed to retain that nationality of Aliens. unless he has subsequently acquired by naturalization or otherwise some other nationality and is still re- Aliens Order, cognised by the sovereign or state whose nationality he has acquired as entitled to protection.

(2.) Where an alien is recognised as a national by the law of more than one foreign state or where for any reason it is uncertain what nationality (if any) is to be ascribed to an alien, that alien may at the discretion of the Governor be treated either as the national of the state with which he is in the opinion of the Governor most closely connected for the time being in interest or sympathy or as being of uncertain nationality or of no nationality.

(3.) Where any deportatiou order under the Deporta- tion Ordinance, 1917, as amended by this Ordinance is Ordinance

in force against any person that person shall, unless the No. 25 of Governor otherwise directs, be deemed to retain his nationality as at the date of the order notwithstanding any intervening naturalization, marriage or any other

event.

3.-(1) For the purpose of enforcing the provisions Regulations of any Treaty of Peace concluded or to be concluded for enforcing between His Majesty and any Power with which His Treaty of Majesty was at war in the year nineteen Lundred and eighteen, the Governor in Council may make regulations Aliens requiring information to be given as to the property, Restriction liabilities, and interests of former enemy aliens, and for (Amend preventing (without notice or authority) the transfer of men det.

(2.) For the purposes of this section the term "former enemy alien" shall have the same meaning as

in the Enemy Aliens Restriction Ordinances, 1919 and Ordinances

4.-1.) It shall be lawful for the Governor in Passport Council to make regulations for the following Regulations, purposes:

(a) requiring persons entering the Colony to have and produce passports and excluding per- sona not provided with valid passports:

b) determining the form and validity of such

passports and

incidental thereto :

any matters

(c) placing obligations on the owners, agents. charterers or masters of ships in order to ensure or facilitate the carrying out of the objects of any regulations relating to pass-

porte.
