I am directed by Earl Curzon of Kedleston to acknowledge
the receipt of your letter of the 21st instant (No. 44009/1920) with regard to the difficulties which have arisen in the applica- tion of Articles 3 and 4 of the China Companies (Amendment) Order in Council 1919, and the proposed amendment of the Hongkong
Ordinance No. 31 of 1915 in connection therewith.
I am to inform you that a telegram has been received from His Majesty's Chargé d'Affaires at Peking to the effect that the
Crown Advocate advises, that, assuming that an amending Order in Council is passed in Hongkong the position of the British American Tobacco Company under the proposed arrangement (1.e. transfer of head office to Hongkong) will not be affected thereby,
Lord Curzon proposes however to defer his request to Lord
Milner that instructions should be sent to the Governor of Hongkong to amend the Ordinance, until the receipt of a despatch from His Majesty's Chargé d'Affaires at Peking which is now on its way.
