Article 1(x) of the Treaty of Peace (Austria) Order, 1920, as adapted by this Ordinance, gives the Governor power to appoint sub- ordinate officers to the Clearing Office and it was therefore/neces-

sary to confer/power in section 3(1) of the Ordinance. In the case of the Treaty of Peace Order, 1919, the corresponding power was conferred in the paragraph which dealt with the United Kingdom Clear- ing office, and it was therefore thought better to confer a similar power in section 3 of Ordinance No. 3 of 1920.

5. Article 1(1) of the Treaty of Peace (Austria) Order, 1920, ap plies to the local Clearing Office in Hongkong the provisions re- lating to the United Kingdom Clearing Office, and accordingly confers upon the head of the Hongkong Clearing office the necessary powers. This officer, however, has other duties besides his Clearing Office duties, i.e., similar duties to those imposed upon the Custodian in the Treaty of Peace Order, 1919, and the Treaty of Peace (Austria) Order, 1920,1⁄2h3⁄41⁄2 does not expressly extend to any local adminis- trator what may be called the Custodian powers of the United Kingdom Administrator. Accordingly section 3(2) of the ordinance confers

upon the Hongkong administrator all the powers conferred by the

Order upon the United Kingdom administrator.

6. There is one omission in the Schedule to the Ordinance, as the

word "Governor" should have been substituted for the word "Treasury"

in the second place where the latter word occurs in article 1(x)

of the Order. It is suggested that it is unnecessary to make

this amendment now because the expenditure on the Austria Clearing

office in this Colony will be fully authorised by the approval of

the Secretary of State for the Colonies and by the local Appropria-

tion Ordinances, and this expenditure will probably be nominal.

In my opinion this is an Ordinance to which His Excellency the Governor may properly assent in the name of His Majesty and on His

behalf.
